Terms of Service

1. Acceptance of Terms

By creating an account or using Realtorhub AI (“the Platform,” “the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform.

These Terms apply to all users of the Platform, including registered agents, administrators, and any other person who accesses or uses the Service.

2. Eligibility

The Platform is intended for use by licensed real estate agents and brokers in Canada, including but not limited to those registered with provincial regulatory bodies such as the Real Estate Council of Ontario (RECO), RECBC, RECA, and equivalent bodies in other provinces. By registering, you represent and warrant that:

• You hold a valid, current registration with the applicable provincial real estate regulator;
• You are using the Platform on behalf of yourself or a licensed brokerage;
• You are at least 18 years of age; and
• Your use of the Platform complies with all applicable laws.

We reserve the right to verify your registration and to suspend or terminate your account if we cannot confirm your eligibility.

3. AI Disclaimer — Important

What AI reports are

The Platform uses Anthropic’s Claude AI to read application documents, summarise income and employment information, flag potentially missing documents, and surface publicly available legal records. The output is a structured summary designed to save you time.

What AI reports are not

• A legal determination of a tenant’s creditworthiness or suitability
• A consumer credit report under the Consumer Reporting Act (Ontario)
• Legal advice from a lawyer or paralegal
• A guarantee of accuracy — AI can misread documents, miss context, or produce errors

Your responsibility

You are solely responsible for any tenancy decision you make. You must independently verify material information in each application, including income, employment, and references. Realtorhub AI and its affiliates are not liable for decisions made based on AI-generated reports.

CanLII searches

Searches of the CanLII legal database are conducted by name matching and may produce false positives, miss records, or return outdated information. CanLII results must be independently verified. Do not rely on CanLII search results alone to make or deny a tenancy decision.

4. MLS & Repliers Data Licensing

The Platform may display MLS listing data sourced through Repliers Inc. or other licensed data providers. This data is provided under licence from the Toronto Regional Real Estate Board (TRREB) and affiliated boards.

• MLS data may only be used for legitimate real estate purposes as permitted under TRREB rules.
• You may not scrape, export, redistribute, or commercially exploit MLS data obtained through the Platform.
• MLS data displayed on the Platform is subject to change and may not reflect the current status of a listing.
• Realtorhub AI makes no representations about the accuracy or completeness of MLS data.

5. Gmail Integration

If you connect your Gmail account, you authorise the Platform to access emails related to rental applications on your behalf. By connecting Gmail you confirm that:

• You are the owner of the Gmail account or have authority to grant access;
• You have obtained any necessary consent from applicants whose information appears in those emails; and
• You will disconnect Gmail access if you no longer wish us to process emails.

Our use of Google user data is governed by the Google API Services User Data Policy. We do not use Gmail data for advertising or AI model training.

6. Acceptable Use

You agree not to use the Platform to:

• Violate any applicable federal, provincial, or municipal law;
• Discriminate against applicants on prohibited grounds under the Ontario Human Rights Code (see Section 7);
• Upload false, misleading, or fraudulent information;
• Attempt to gain unauthorised access to other accounts or systems;
• Scrape, copy, or systematically extract data from the Platform;
• Use the Platform to harass, defame, or harm any person;
• Reverse-engineer or attempt to extract source code from the Platform; or
• Resell or sublicense access to the Platform without written permission.

7. Human Rights & Fair Housing

AI-generated screening reports must never be used to discriminate against applicants on any prohibited ground. You are solely responsible for ensuring your use of the Platform complies with the Ontario Human Rights Code, the Residential Tenancies Act, 2006, and all other applicable anti-discrimination legislation.

Realtorhub AI does not collect or use protected characteristics (race, religion, national origin, etc.) as screening factors. If you believe an AI report has produced a result influenced by protected characteristics, contact us immediately using our contact form.

8. Accounts & Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Use a strong, unique password and not share your credentials with anyone;
• Notify us immediately using our contact form if you suspect unauthorised access; and
• Log out of your account after each session on shared devices.

We reserve the right to suspend or terminate accounts that show signs of compromise or abuse.

9. Fees & Billing

Realtorhub AI is currently in early access and is offered at no charge to invited agents. We reserve the right to introduce subscription pricing in the future, at which point we will provide at least 30 days’ advance notice by email before charging existing users.

Any future fees will be clearly disclosed and require affirmative acceptance from you before billing commences.

10. Intellectual Property

All content, software, design, trademarks, and other intellectual property on the Platform are owned by or licensed to Realtorhub AI. Nothing in these Terms grants you any ownership rights in the Platform.

You retain ownership of the data you upload to the Platform (listing details, application documents). By uploading, you grant us a limited licence to process that data solely for the purpose of providing the Service to you.

AI-generated screening reports are provided to you under a limited, non-exclusive licence for your internal professional use. You may not resell or distribute reports.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Realtorhub AI and its officers, directors, employees, and affiliates shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages;
• Loss of profits, revenue, data, or business opportunity;
• Damages arising from your reliance on AI-generated screening reports;
• Damages arising from tenancy decisions made using the Platform; or
• Inaccuracies in MLS data, CanLII search results, or third-party information.

In no event shall our total liability to you exceed the greater of (a) the total fees you paid us in the 12 months preceding the claim, or (b) CAD $100.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Realtorhub AI and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including legal fees) arising from:

• Your use of the Platform in violation of these Terms;
• Your violation of any law or regulation; or
• Any tenancy decision you make using or in connection with the Platform.

13. Termination

You may close your account at any time by contacting us using our contact form. Upon closure, we will delete your personal information as described in our Privacy Policy — Data Retention.

We may suspend or terminate your account immediately, without notice, if you breach these Terms, violate applicable law, or if we reasonably believe your account poses a security risk to the Platform or other users.

Sections 3, 4, 10, 11, 12, and 14 survive termination of these Terms.

14. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved in the courts of Ontario, and you consent to the exclusive jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Continued use of the Platform after the effective date of revised Terms constitutes your acceptance.

If you disagree with updated Terms, you must stop using the Platform and may close your account before the effective date.
